If you make, store, distribute or sell food in any form – a restaurant, a home tiffin service, a packaged-snack brand or a food delivery kitchen – the law requires you to hold an FSSAI registration or license before you start. It is issued by the Food Safety and Standards Authority of India under the Food Safety and Standards Act, 2006, through the online FoSCoS portal, and your 14-digit FSSAI number must appear on your packaging, premises and online listings.

And 2026 is the year the rulebook changed. The FSS (Licensing and Registration of Food Businesses) Amendment Regulations, 2026 – notified on 10 March 2026 – abolished renewals in favour of perpetual validity, and a separate FSSAI Order dated 13 March 2026 rewrote the turnover thresholds from 1 April 2026. Many food businesses that previously needed a State License now qualify for the simple ₹100 Basic Registration. Who Needs FSSAI Registration?

You are a Food Business Operator (FBO) and need FSSAI authorisation if you:

  • Run a restaurant, cafe, dhaba, cloud kitchen or catering business – dine-in, takeaway or delivery.

  • Sell food from home – tiffin services, home bakers, pickles, snacks, chocolates, meal preps.

  • Manufacture, process, repack or label any food product – from spices to packaged snacks.

  • Trade, distribute, store or transport food – retailers, wholesalers, warehouses, cold storage.

  • Sell food online – on Swiggy, Zomato, ONDC, your own website or even Instagram.

  • Import or export food products – importers need a Central License regardless of turnover.

2026 relief for street vendors: vendors and hawkers already registered under the Street Vendors Act, 2014 are now deemed registered under the FSS Act – no separate FSSAI application needed.

Your category depends on annual turnover and your kind of business. The thresholds below apply from 1 April 2026 per the FSSAI Order dated 13 March 2026:

Turnover is not the only test: certain kinds of business need a Central License irrespective of turnover – importers, e-commerce food platforms, nutraceutical and health-supplement manufacturers, proprietary food makers, 100% Export Oriented Units, exporters, food businesses at airports and seaports, 5-star and above hotels, and head offices of multi-state operations. Existing licensees are being migrated automatically to their new category on FoSCoS with no modification fee – and if your turnover now falls under ₹1.5 crore, converting down to Basic Registration can cut your annual fee dramatically. What Changed in 2026: Perpetual Validity & No More Renewals

The Amendment Regulations notified on 10 March 2026 are the biggest overhaul of food licensing since 2011. The headline changes:

  • Perpetual validity: a license or registration now remains valid unless suspended, cancelled or surrendered – the 1–5 year validity and renewal cycle is gone.
  • Annual fee still applies: you must keep paying the yearly fee (payable in advance for multiple years). Non-payment or a missed return = deemed suspension until dues and penalty are cleared.
  • Risk-based inspections: inspection frequency is now driven by commodity risk and your compliance history, not a fixed calendar – clean operators get inspected less.
  • Street vendor relief: vendors registered under the Street Vendors Act, 2014 are deemed FSSAI-registered.

FSSAI registration and licensing is the mandatory authorisation every food business in India needs under the Food Safety and Standards Act, 2006. It is issued by the Food Safety and Standards Authority of India (FSSAI) through the FoSCoS portal, and comes in three categories – Basic Registration, State License and Central License – based mainly on annual turnover and the kind of food business.

Every Food Business Operator (FBO) – manufacturers, restaurants, cloud kitchens, home kitchens, tiffin services, caterers, retailers, wholesalers, transporters, storage units, importers and online food sellers. If you make, handle, store, distribute or sell food commercially in any form, you need at minimum a Basic FSSAI Registration before you start.

The FSS (Licensing and Registration of Food Businesses) Amendment Regulations, 2026, notified on 10 March 2026, introduced four major reforms: perpetual validity of licenses and registrations (no more renewals), revised turnover thresholds effective 1 April 2026, deemed FSSAI registration for street vendors registered under the Street Vendors Act 2014, and a risk-based inspection framework replacing fixed-calendar inspections.

Per the FSSAI Order dated 13 March 2026, effective 1 April 2026: Basic Registration applies up to ₹1.5 crore annual turnover (earlier ₹12 lakh), State License applies from ₹1.5 crore to ₹50 crore (earlier ₹12 lakh to ₹20 crore), and Central License applies above ₹50 crore. Certain business types need a Central License regardless of turnover. Existing licensees are migrated to the new categories on FoSCoS without a modification fee.

No. Under amended Regulation 2.1.7, an FSSAI license or registration granted under the new framework is valid and subsisting unless suspended, cancelled or surrendered – it never expires. However, the annual license or registration fee remains payable every year (and can be paid in advance for multiple years), and returns must still be filed on time.

Non-payment of the annual fee or failure to file the required return by the due date results in deemed suspension of the license or registration under the 2026 amendment. A suspended license means you cannot legally operate; it is revoked (restored) only after the pending fee and applicable penalty are paid.

Government fees: Basic Registration ₹100 per year; State License roughly ₹2,000 to ₹5,000 per year depending on business activity and capacity; Central License ₹7,500 per year. As per the FoSCoS Kind-of-Business eligibility matrix, certain categories need a Central License irrespective of turnover – including food importers, e-commerce food platforms, nutraceutical and health supplement manufacturers, proprietary food manufacturers, 100% Export Oriented Units, exporters, radiation processing units, food businesses at airports and seaports, 5-star and above hotels, and head offices of businesses operating in more than one state.

Basic Registration is typically the fastest – often granted within a few working days, and eligible small businesses can use instant or Tatkal processing on FoSCoS. State and Central Licenses usually take around 30 to 60 days because document scrutiny and a premises inspection may be involved. A complete, correctly-categorised application is the biggest factor in speed.

For Basic Registration: photo ID of the operator, a passport photo, proof of business premises and the completed Form A details. For State/Central Licenses (Form B): additionally a Food Safety Management System (FSMS) plan, list of food categories, proof of constitution, and for manufacturers a layout plan of the unit, list of machinery and a water test report. Yes. Selling food from home – tiffin services, bakers, picklers, snack makers, and cloud or ghost kitchens – is a food business under the FSS Act. With the Basic Registration threshold now raised to ₹1.5 crore turnover, almost all home and cloud kitchen operators qualify for the simple ₹100-per-year Basic Registration rather than a State License.

Yes. Food delivery platforms require a valid FSSAI license number before listing a restaurant or kitchen, and the number must be displayed on the platform. Selling food through your own website or social media also makes you a Food Business Operator who must hold at least a Basic Registration.

FoSCoS (Food Safety Compliance System) at foscos.fssai.gov.in is FSSAI's official online portal for all licensing and registration work – new applications, modifications, annual returns and fee payments. It replaced the older FLRS system in 2020. All FSSAI applications are filed and tracked through FoSCoS.

Under the 2026 amendment, street food vendors and hawkers already registered under the Street Vendors (Protection of Livelihood and Regulation of Street Vending) Act, 2014 are deemed to be registered under the FSS Act – removing the earlier dual-compliance burden. Vendors not registered under the Street Vendors Act still need a normal FSSAI Basic Registration.

Every FSSAI license or registration carries a unique 14-digit number. It must be printed on food packaging and labels, displayed prominently at the business premises, and shown on invoices and online listings. Missing or incorrect display of the FSSAI number is a compliance violation.

Operating a food business without the required registration or license is an offence under Section 63 of the Food Safety and Standards Act, 2006, and can attract penalties of up to ₹5 lakh. Platforms will also delist you and premises can face enforcement action – getting registered before starting is far cheaper than regularising later.

Yes. FSSAI licensing is premises-specific, not brand-specific. Each outlet, kitchen, warehouse or unit needs its own registration or license based on that location's activity and turnover. Businesses operating in more than one state additionally need a Central License for the head office or registered office.
